Justice orders the MNAC to transfer Sijena’s paintings in seven months

Jul 24, 2025

The Court of First Instance and Instruction No. 2 of Huesca He has finally ordered the definitive execution of the sentence for the transfer of the paintings of the Chapter Room of the Monastery of Sijena from the National Museum of Art of Catalonia. The order, confirmed by the government of Aragon, it gives the MNAC seven months for the return according to the schedule proposed by the technicians of the DGA, who have green light to access rooms 16 and 17, where the frescoes are found, “during the time that is required” although these have to be closed to the public.

On the car, known on Wednesday, there is no appeal “without prejudice to the opposition can formulate the executed” in the next ten days. It is the same period that the judge gives to the MNAC to establish an alternative schedule of the works. Otherwise, they must comply with “in their own terms” the judgment of the Supreme Court.

According to the measures to this last resolution, Aragonese technicians will have access to the paintings assembly system and all the documentation linked to them that is stored in the MNAC files. Similarly, the Barcelona Museum is obliged to provide “all the data on the environmental conditions (relative temperature and humidity) of these rooms and those in which the fragments have previously exposed”, in reference to the transfers within the facilities.

Likewise, a “photogrammetric survey of rooms 16 and 17” must be carried out and the first will be previously emptied of the rest of the exhibition content (showcases), “as well as the control of luminaires, as appropriate at the time of the action within the shortest possible period”.

The court rejects fines

On the other hand, in the car it is rejected “without prejudice to what can be remembered later” the request of the DGA to impose pecuniary fines of 5,000 euros for each day that the weekly milestones set in the schedule are breached. The magistrate recognizes the “especially complex” that is the execution “given the nature and patrimonial value of the goods that must be restored, being necessary certain deadlines” for the disassembly, packaging and subsequent transfers. Thus, they add, only the Aragonese part has contributed this roadmap.

The Aragon Government activated the petition for the forced execution of the transfer on June 27, once the 20 business days established by the law since the last pronouncement of the Supreme, which unleashed a pending issue of vote of the magistrates for years has ended. The regional executive insists that the process can be carried out without jeopardizing the integrity of the frescoes. This week, President Jorge Azcón argued that this issue was already resolved during the judicial process and accused the Generalitat and the MNAC to grab “subterfuges” to delay the execution.
